Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the GreenThumb mobile application ("App"), operated by Giacomo Matzeu ("we", "us", or "our"). By accessing or using the App, you confirm that you are at least 18 years old and agree to these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years of age to use GreenThumb. By using the App, you represent and warrant that you meet this requirement. We do not knowingly provide services to persons under 18. If we become aware that a user is under 18, we will terminate their account.

3. Your Account

To use GreenThumb, you must create an account with a valid email address. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at support@greenthumb.app

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Payments

Free Tier

GreenThumb offers a free tier with access to core features including unlimited plant tracking, plant identification, and community access.

GreenThumb Pro

Pro features are available via a paid subscription (monthly or annual), processed through Google Play. Pro includes AI advisors, weather-aware scheduling, calendar sync, and advanced diagnostics.

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• A 7-day free trial is available for new subscribers — no charge until the trial ends
• Cancellations take effect at the end of the current billing period; no partial refunds are issued
• Pricing may change with reasonable advance notice

All billing is managed by Google Play. For billing issues, contact Google Play support directly.

5. AI-Generated Content

GreenThumb uses artificial intelligence to provide plant identification, disease diagnosis, care advice, and seasonal tips. You acknowledge that:

• AI-generated content is provided for informational purposes only and is not a substitute for professional horticultural advice
• Accuracy is not guaranteed — AI models can make mistakes
• We are not liable for any plant damage, loss, or harm resulting from following AI-generated advice
• Plant photos submitted for identification are processed by third-party AI providers (Anthropic, Plant.id) in accordance with our Privacy Policy

6. Community & User Content

GreenThumb includes a community feature where users can share plant photos, comments, and posts ("User Content"). By posting User Content, you:

• Grant us a non-exclusive, royalty-free license to display your content within the App
• Confirm you own or have the right to share the content
• Agree not to post content that is offensive, illegal, misleading, or violates others' rights

We reserve the right to remove any User Content that violates these Terms without notice.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, scrape, or exploit the App or its APIs
• Create multiple accounts to abuse free trial offers
• Harass, spam, or harm other community members
• Upload content that contains malware or harmful code

8. Intellectual Property

All content, design, code, and trademarks in GreenThumb are owned by Giacomo Matzeu unless otherwise stated. You may not copy, reproduce, or distribute any part of the App without our written permission. Your own User Content remains yours.

9. Disclaimer of Warranties

GreenThumb is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or free of viruses. Your use of the App is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Giacomo Matzeu shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of GreenThumb, including but not limited to plant loss, data loss, or loss of profits. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of Italy. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Italy. If you are an EU consumer, you may also benefit from mandatory consumer protection provisions of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email. Continued use of GreenThumb after changes are posted constitutes your acceptance of the updated Terms.

13. Account Deletion

You may delete your account at any time via the account deletion page. Upon deletion, your data will be permanently removed within 30 days in accordance with our Privacy Policy. Active subscriptions must be cancelled separately through Google Play.
